When should I challenge a traffic fine?
President of the Law Society of South Australia Tim White said that in most situations, most people are better off accepting the expiation notice, paying a fine and getting on with their lives.
“The sensible approach is to approach it with caution,” Mr White said.
“Unfortunately, when you challenge an expiation notice, it [goes] into the courts system.”And if you’re unsuccessful, the court costs you have to then incur are often considerably more than what the expiation notice was.”
He said people who challenge traffic expiations are also at a disadvantage because they might not know what evidence there is for or against them.
“So the strength of your case is really not known at the time you’re making a decision [about whether] to challenge the expiation,” Mr White said.
