Why Christmas Can Be Challenging for Separated Parents
The Christmas holiday season can be one of the most challenging times of the year for separated parents. Deciding where children will spend Christmas Day, Christmas Eve or the summer holidays often brings added tension and stress. Acting early can make all the difference.
Court Deadlines for Parenting Arrangements
If you and the other parent cannot agree on Christmas arrangements, the Federal Circuit and Family Court of Australia (FCFCOA) require you to file an application before the second Friday in November — this year, 14 November 2025. This deadline applies to the filing of the application, not the hearing date. In some cases, matters may not be heard until very close to Christmas, so forward planning is essential.
Resolving Disputes Outside of Court
The Court also expects parents to make a genuine effort to resolve disputes before filing an application. Mediation or negotiation can often resolve issues without the need for litigation. Applications to the Court should always be considered a last resort. If you believe an urgent listing is necessary, this should be clearly indicated in your application.
What Happens If You Miss the Deadline
Missing the 14 November deadline may mean your matter is listed after the Christmas period. In that situation, you will need to continue to try and reach agreement directly with the other parent. Lawyers can assist with negotiations and drafting temporary arrangements to avoid uncertainty.
