What Is A Conveyancer?
Conveyancing is the legal and administrative work required to transfer property ownership. It applies whether you’re buying, selling or transferring property between family members.
A conveyancer is like a personal-assistant-meets-legal-advisor, and they can help you:
- Advise about the terms and special conditions of your contract;
- Liaise with your lender and real estate agent;
- Calculate and adjust rates and taxes;
- Stamp documents;
- Ensure land is transferred unencumbered;
- Attend to settlement and lodgement of documents;
- Arrange payment of outstanding liabilities against the land and;
- Notify and confirm settlement with the required parties and agent.
-
Why should I hire a lawyer instead of a non-lawyer conveyancer?
Only a lawyer can give legal advice, negotiate disputes, draft complex clauses or resolve unexpected issues in the contract. If something becomes complicated, a lawyer can act immediately.
-
When should I engage a conveyancer?
Ideally before you sign the contract. Early involvement means we can warn you about risks and ensure the contract protects your interests.
-
What is a Form 1?
A Form 1 is the Vendor Disclosure Statement required under South Australian law. It outlines details about the property that may affect the buyer’s decision. Incorrect Form 1s can delay or invalidate settlement, so accuracy matters.
What searches do you perform?
We typically order:
- council and water rates
- zoning and planning
- land tax
- easements and encumbrances
- heritage or environmental notices
- government charges
The exact list depends on the property type.
-
What happens on settlement day?
Funds are transferred, mortgages are discharged or registered, and the title moves to your name. Once complete, the real estate agent can release the keys.
-
Can you help with private sales (no real estate agent)?
Yes. We prepare the contract, Form 1, handle deposit arrangements, order searches and manage settlement. This is common with family sales or direct vendor-purchaser agreements.
-
Do you help first-home buyers?
Absolutely. We explain grants, stamp duty concessions (where applicable), contract timelines, and what to look out for.
-
Do you handle commercial and rural property matters?
Yes. We regularly manage business settlements, commercial leases, farm transfers, water licences and Crown lease matters.
