In episode four of the Surviving Separation podcast, TGB family law partner Wendy Barry discusses the often complex issue of ‘who get’s the kids?’

Ms Barry, an Accredited Family Law Specialist, talks about the legal process and challenges involved in the care and custody of children.

Central to the discussion is the importance of working towards “the best interests of the children”.

“The parents may have fallen out of love and the children are the collateral damage along the way and the focus of parents should always be to protect children from conflict, not involve them,” Ms Barry told Surviving Separation.

First and foremost the court seeks to encourage the parents to reach their own resolution.

“The court values and appreciates that parents usually are best placed to make decisions about the future care arrangements of the children,” she said.

Also in question is common assumptions of “equal time” and “full custody”, and what to do in amicable situations where agreements have been reached.
